By accessing or using LeakTrace services, you agree to these Terms. This includes receiving outreach communications if your consent-based identifiers have been detected in monitored criminal-targeting sources.

01Description of Services

LeakTrace Inc provides identity exposure monitoring and breach alerts to individuals and businesses. Our platform, powered by proprietary analysis tools verified by human analysts, assesses breach severity with confidence scores and monitors for new detections tied to your anchor points — full name, email, and phone. This helps you identify exposure before fraud occurs.

When users sign up and agree to these Terms, they consent to detected data being displayed in their internal dashboard for verification and reporting purposes.

02Scope of Services

LeakTrace aggregates and reports available breach data from multiple sources, including compromised credential databases and criminal-targeting sources. Our proprietary analysis tools, verified by human analysts, assess breach data with manual oversight, assigning confidence scores to prioritise risks. We do not guarantee the completeness, timeliness, or absolute accuracy of all breach data — some leaks may go undetected, and new breaches may occur after your report. Users are responsible for staying vigilant about their security beyond our Services.

For credibility, we provide anonymised text extracts or logs from our Compliance Audit Trail, withholding specific sources to protect proprietary methods.

2.1 — Scope of Monitored Data

LeakTrace monitors a range of data points beginning with consent-based identifiers (full name, email address, phone number) cross-referenced with monitored criminal-targeting sources. Depending on breach findings, we may identify additional data points including:

  • Digital & Online: Email address, password, IP address, online purchase history, subscription and membership data.
  • Identity Security & Protection: Social Insurance Number (SIN), Social Security Number (SSN), date of birth, phone number, driver's licence number, passport number, Tax Identification Number (TIN), physical address, employment history, government benefits information, security questions and answers, Vehicle Identification Number (VIN).
  • Financial Fraud Alerts & Protection: Credit card number, bank account number, routing number, payment card PINs, financial transaction history, credit score, loan application monitoring.
  • Sensitive Information: Medical records, health insurance information.
  • Additional Monitoring: Phishing attack alerts, data deletion requests.

03Account Registration
  • Users must be 18 years or older to register.
  • You agree to provide accurate and current information during sign-up, including your full name, email, and optionally date of birth, to verify your identity against pre-identified consent-based identifiers from monitored criminal-targeting sources.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • We reserve the right to suspend or terminate accounts for fraudulent activity or violations of these Terms.
  • By registering, you acknowledge that LeakTrace performs automated and manual security scans. You grant us a limited licence to utilise your anchor points (email, phone, name) solely for the purpose of identifying and reporting security risks found in monitored criminal-targeting sources.
04Fees, Subscription & Billing
4.1 — Pricing & Payment

LeakTrace offers two service segments: Individual and Business. All prices are in USD plus applicable taxes unless stated otherwise.

All fees are non-refundable except in cases of billing errors or duplicate charges upon review, or as required by applicable consumer protection laws. Payments are processed securely through Stripe.

4.2 — Subscription Plans
  • Subscriptions are billed on a monthly or annual basis and renew automatically unless cancelled.
  • Users will receive prior notice before renewal charges are applied.
  • Users can cancel at any time via their account dashboard. Cancellations apply to future billing cycles only.
  • Account management is available at getleaktrace.com/dashboard.
4.3 — Chargebacks & Fraud
  • Unauthorised chargebacks may result in account suspension or permanent banning.
  • If you experience a billing issue, contact [email protected] before disputing charges.
05Data Use, Privacy Compliance & Retention
  • By using LeakTrace, you acknowledge that we collect, store, and analyse data tied to your consent-based identifiers — full name, email, and phone — identified in monitored criminal-targeting sources to provide security alerts and protect you from fraud.
  • We comply with Canadian and US privacy laws, including PIPEDA and CCPA. Users can exercise their rights by contacting [email protected].
  • We do not sell or share your data with third parties for marketing purposes.
  • LeakTrace is not responsible for removing leaked data from third-party websites or criminal-targeting sources — our Services focus on alerting you to act. Users seeking data removal should contact the relevant entities directly.
  • Data will only be displayed in your internal dashboard after you have explicitly opted in during signup, authorising us to trace your anchor points across monitored criminal-targeting sources.
  • Data Retention: LeakTrace retains user data only for as long as necessary to provide Services, comply with legal obligations, and enforce agreements. You may request account and data deletion at any time by contacting [email protected]. We will permanently remove your data at your request, except where legally required to retain it (e.g., audit logs retained for 3 years).
06User Responsibilities & Acceptable Use

By using LeakTrace, you agree not to:

  • Engage in fraudulent activities or use LeakTrace to access unauthorised data.
  • Attempt to hack, reverse-engineer, or disrupt our platform.
  • Share confidential breach reports with unauthorised third parties.
  • Use our Services for malicious purposes, including identity theft.

You are responsible for maintaining the security of your own accounts and passwords. You acknowledge that failure to act upon breach notifications — for example, freezing accounts or changing passwords after detection — may result in further exposure, and LeakTrace is not liable for damages due to user inaction.

07Service Modifications & Termination

LeakTrace reserves the right to modify, suspend, or discontinue any feature of the Service at any time without notice. We also reserve the right to suspend or terminate accounts that violate these Terms or engage in misuse.

08Third-Party Services & Integrations

LeakTrace may utilise third-party services including payment gateways, fraud monitoring, and data security tools. This includes third-party breach data sources we aggregate to identify anchor points and deliver breach reports. We are not responsible for the privacy practices or policies of third-party providers.

09No Guarantee of Complete Security

LeakTrace provides breach detection and monitoring tied to your anchor points but does not guarantee the prevention of future security breaches or the removal of leaked data from monitored criminal-targeting sources. We are not liable for damages resulting from the misuse of your personal data.

10Limitation of Liability & Indemnification
  • LeakTrace, its affiliates, and employees shall not be held responsible for any direct, indirect, or consequential damages arising from Service use.
  • Our total liability for any claims related to the Service shall not exceed the total fees paid in the past 12 months.
  • Users agree to indemnify, defend, and hold harmless LeakTrace from any claims, damages, losses, or legal expenses arising from: failure to act on breach notifications; unauthorised access to user accounts; or financial loss, fraud, or identity theft.
Outreach Indemnification

LeakTrace provides security notifications as a public safety service. By using the Service, you agree that LeakTrace is not liable for any perceived distress or alarm caused by the receipt of accurate breach notifications sourced from criminal-targeting databases.

11Refund Policy & Charge Disputes

Refunds are only available for the Identity Audit Report fee or monitoring subscription fee in cases of duplicate charges or billing errors, verified upon review. Once a report has been generated or a subscription period begins, all sales are final and no refunds will be issued, except as required by law.

12Prohibited Uses & Security Violations

Users may not copy, modify, reverse-engineer, or resell LeakTrace data. Any unauthorised access to our systems or attempts to bypass security measures will result in account termination and legal action.

13Government Requests & Compliance

LeakTrace may disclose user information if required by law, court order, or law enforcement request. Affected users will be notified unless prohibited by law.

14Dispute Resolution & Arbitration

Any disputes arising under these Terms shall first be attempted to be resolved informally. If unresolved, disputes shall be settled through binding arbitration in Toronto, Ontario, Canada, conducted under the rules of the ADR Institute of Canada (ADRIC).

Users waive the right to participate in class-action lawsuits against LeakTrace. Any arbitration or legal proceedings shall be conducted in English and held in Toronto, Ontario, Canada.

15Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. For users in the United States, any legal actions not subject to arbitration shall be brought in the courts of Delaware, USA, unless otherwise required by applicable US law.

16–20General Provisions

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect to the maximum extent permitted by law.

17. Entire Agreement

These Terms, together with our Privacy Policy and Security Standards, constitute the entire agreement between you and LeakTrace regarding the use of our Services. They supersede all prior or contemporaneous agreements, representations, warranties, or understandings, whether oral or written.

18. Waiver

No failure or delay by LeakTrace in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right preclude any other or further exercise thereof.

19. Consumer Protection Laws

Certain provisions of these Terms, including refund policies and limitations of liability, may be subject to mandatory consumer protection laws in Canada (e.g., Ontario's Consumer Protection Act) or the United States (e.g., California consumer protection laws). In such cases, applicable consumer protection laws will take precedence to the extent they provide greater rights or protections to you.
