Is there a faster way than the UDRP to shut down a look-alike?

Sometimes.

01

What is URS?

The Uniform Rapid Suspension System is a rights protection mechanism that complements the existing Uniform Domain-Name Dispute Resolution Policy (UDRP) by offering a lower-cost, faster path to relief for rights holders experiencing the most clear-cut cases of infringement.

ICANN describes the Uniform Rapid Suspension System (URS) as a lower-cost, faster path than the UDRP for rights holders with the most clear-cut cases of infringement.

ICANN's materials for complainants are built around meeting a 'clear and convincing' evidence burden.

02

When does URS fit a look-alike?

Uniform Rapid Suspension (URS) Checklist: Meeting the 'Clear and Convincing' Evidence Burden in a Proceeding

URS fits when there is little room for argument: your trademark, a name that copies it, and emails or pages that use it to deceive. If the facts are mixed, the UDRP is the usual route.

Whether URS is open for a given name depends on the domain's ending, so confirm with a provider before you file.

03

Who handles URS complaints?

URS Service Providers: Asian Domain Name Dispute Resolution Center (ADNDRC) MFSD srl National Arbitration Forum (NAF)

ICANN lists three URS providers: the Asian Domain Name Dispute Resolution Center (ADNDRC), MFSD srl and the National Arbitration Forum (NAF).

  1. Confirm your trademark registration.
  2. Gather the look-alike, the emails or pages it was used for, and the dates.
  3. Ask a URS provider whether the domain's ending is covered, then file with it.
